Purchase terms
1. General provisions
1.1 These terms of use of this online store (hereinafter referred to as the "Rules") are a legally binding document that establishes the mutual rights, obligations, and responsibilities between the Buyer (hereinafter - the "Buyer") and the Seller Lipdukai.eu, (hereinafter - the "Seller") when the Buyer purchases goods and/or services from the Seller's online store "Lipdukai.eu" (hereinafter - the "Store").
1.2 The Rules apply when the Buyer in any way or form uses the Store: provides personal or other data, places an order for goods offered by the Store and pays for these goods, reads the information provided in the Store, or otherwise uses the online store (hereinafter collectively - "Services").
1.3 The Buyer is not given the opportunity to place an order for goods in the Store if the Buyer is not familiar with the Rules. In all cases, it is considered that the Buyer is familiar with the Rules and agrees to them if, before ordering goods, he confirms his consent to the Rules by checking the box next to the statement "I confirm that I have read and agree to the rules." In cases where the Buyer partially or completely disagrees with all or certain parts of the Rules, the Buyer does not have the right to use any Lipdukai.eu Services. Otherwise, it is considered that the Buyer has familiarized himself and unconditionally agreed to all the Rules.
1.4 The Store is released from any liability in cases where losses arise because the Buyer, disregarding the recommendations provided to him and his obligations, did not familiarize himself with the Store's Rules, although he was given the opportunity to do so.
1.5 The Seller reserves the right to change the Rules at any time. The Rules applicable to the Buyer are those in force at the time of placing the order.
1.6 Lipdukai.eu has the right to buy:
1.6.1 Individuals over 18 years of age whose legal capacity is not restricted by court order and their authorized representatives. Individuals under 18 years of age can purchase goods from Lipdukai.eu only with the consent of their parents or guardians;
1.6.2 Legal entities and their authorized representatives.
2. Privacy policy
2.1 When placing an order, the Buyer must provide personal data necessary for the fulfillment of the Buyer's order: Buyer's name, address for the delivery of goods, email address for sending informational messages about the order status, Buyer's phone number, methods of delivery and payment of goods, and other information necessary for the Seller's Services.
2.2 Any information related to personal data provided by the Buyer to fulfill the order is considered confidential and not disclosed. The Seller undertakes not to disclose such information to third parties, except to the Seller's partners providing services related to the order, payment, and delivery of goods, or other services related to the submission or fulfillment of the Buyer's order. Any other disclosure of personal Buyer information to third parties is always coordinated with the Buyer. In all other cases, any personal data of the Buyer may be disclosed to third parties only in cases provided for by the laws of the Republic of Lithuania.
2.3 By registering with Lipdukai.eu and ordering goods, the Buyer undertakes to keep and not disclose their login data to anyone, and after using the Store's Services, the Buyer must log out of the Lipdukai.eu system. At the same time, the Buyer confirms that he is of legal age and has the right to order goods in the Store. In the event that the Buyer discloses their login data to third parties or, after using the Store's Services, does not log out of the Lipdukai.eu system, the Seller is released from any liability related to this.
2.4 By registering with Lipdukai.eu, the Buyer confirms that they give the Seller the right to collect, accumulate, systematize, use, and process in any way not prohibited by the laws of the Republic of Lithuania all and any personal data that the Buyer directly or indirectly provides to the Seller by visiting Lipdukai.eu and using the Services, under the conditions and procedure established in these Rules.
2.5 The Seller confirms that the Buyer, by registering with Lipdukai.eu, does not give permission to use their email, phone number, address, or other personal data for marketing purposes, except in cases where the Seller themselves, when registering, indicates that they want to receive such information.
2.6 By familiarizing themselves with the Rules, the Buyer confirms that they are informed that while browsing the Store, files sent from the internet server will be placed on their computer.
2.7 The Seller has the right at any time, without prior notice, to restrict or suspend the Buyer's ability to use the Seller's Services. The Seller also has the right to cease the operation of the Store without informing the Buyer.
3. Order confirmation and conclusion of the purchase and sale agreement
3.1 The Buyer's order is considered confirmed, and the purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer, after familiarizing themselves with Lipdukai.eu, forms the shopping cart, provides their personal data, selects the payment method, and clicks the "Confirm order" button.
3.2 Each agreement concluded between the Buyer and the Seller is stored in the Lipdukai.eu database.
4. Buyer's rights and obligations
4.1 The Buyer, following the Rules, has the right to purchase goods from Lipdukai.eu.
4.2 The Buyer must accept the ordered goods and pay for the price of the goods and their delivery.
4.3 The Buyer is responsible for the accuracy of the data provided in the registration form. The Buyer assumes responsibility for the consequences arising from the inaccuracy or incorrectness of the data provided in the registration form.
4.4 The Buyer must keep their login data for the electronic store confidential and not disclose them, ensure that the data is known only to themselves, and use the data only themselves. If there is suspicion that the login data may have been obtained by another person, the Buyer must immediately inform the Seller. All actions performed using the Buyer's identification code are considered to be performed by the Buyer, and the Buyer assumes full responsibility for the consequences of such actions.
4.5 If there are changes in the data provided in the Buyer's registration form, the Buyer must update them immediately.
4.6 The Buyer must use Lipdukai.eu for its intended purpose without causing harm to its operation and stability.
5. Seller's rights and obligations
5.1 If the Buyer attempts to disrupt the operation or stability of the online store, the Seller has the right at any time, without prior notice, to cancel the Buyer's registration, restrict or suspend the Buyer's ability to use the Seller's Services.
5.2 The Seller has the right to temporarily or indefinitely terminate the operation of Lipdukai.eu without informing the Buyer.
5.3 The Seller must provide the Buyer with the opportunity to properly use the services provided by the online store.
5.4 The Seller must deliver the goods ordered by the Buyer to the address specified by the Buyer in the order.
5.5 In case of significant circumstances preventing the Seller from delivering the ordered goods to the Buyer, the Seller undertakes to offer the Buyer a similar product, and if the Buyer refuses to accept the analog of the product or if there is no analog, to refund the Buyer the paid amount within 7 working days. In this case, the Seller is released from liability for non-delivery of goods.
5.6 The Seller must keep the Buyer's provided data and use it only for the sale and delivery of goods, without violating the requirements of the laws of the Republic of Lithuania regarding the protection of personal data.
5.7 If there are links to websites of other companies, institutions, organizations, or individuals in the Seller's online store, the Seller is not responsible for the information or activities on those websites.
6. Determination of goods and their prices
6.1 The characteristics and prices of each product are provided next to each product on Lipdukai.eu.
6.2 Prices on Lipdukai.eu and in the order are indicated in EUR. The price of the product includes value-added tax (VAT).
6.3 The Seller indicates, and the Buyer, by familiarizing themselves with the rules, confirms that they are aware that the products listed on Lipdukai.eu may not correspond in color, shape, or other parameters to the actual size, shapes, and colors of the products due to the characteristics of the display used.
6.4 The Seller reserves the right to change the offer and prices of Lipdukai.eu products at any time.
6.5 The Seller undertakes to provide the Buyer with the quantity of goods specified in the order of suitable quality. The Seller does not assume responsibility in cases where the quantity of delivered goods is inaccurate due to the Buyer incorrectly filling out the order.
7. Payment procedure and terms
7.1 The Seller starts processing the order only after receiving the full payment from the Buyer for the Services.
7.2 The Buyer must pay for the Services no later than within three working days after the order confirmation and conclusion of the purchase and sale agreement.
7.3 The Buyer pays for the ordered goods using one of the methods specified in the Store:
7.3.1 By bank transfer by independently logging into the Buyer's chosen bank's online banking system;
7.3.2 Paysera payment initiation service allows payment through these banks: Swedbank, SEB, Luminor, Citadele, Šiauliai Bank, Medicinos Bank, Revolut.
7.3.3 Paypal payment system
7.4 The Seller undertakes to provide accurate and complete information necessary for the Buyer to fully settle for the Services. However, the Seller does not assume any responsibility for the quality of services provided by banks or the Mokejimai.lt system (this system is administered by "EVP International", UAB, Mėnulio g. 7, LT-04326, Vilnius, Lithuania; Company code 300060819, VAT payer code LT100001261114), and any resulting losses. Also, the Seller does not assume any responsibility for errors made by the Buyer in forming and executing a transfer (e.g., entering an incorrect account number, incorrectly entering the order code, etc.) and any resulting losses.
8. Delivery of goods
8.1 The goods are delivered to the Buyer's account by UAB "Baltic Post" LP EXPRESS courier service or the Seller's representative AB "Lietuvos paštas".
8.2 The Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances. In such cases, the Seller undertakes to immediately inform the Buyer and indicate the delivery time of the goods.
8.3 The goods are delivered to the address specified by the Buyer within 2 - 5 working days in Lithuania, 5-10 working days in European Union countries (unless otherwise indicated) from the receipt of payment for the goods and their transportation. (Depends on the chosen delivery method),
8.4 During the delivery of the goods, the Buyer must check the condition of the shipment together with the transport company's or Seller's representative and, if any damages to the shipment are noticed, indicate them in the document confirming the shipment delivery. If the Buyer accepts the shipment and signs the document confirming the shipment delivery without any comments, it is considered that the delivered shipment is without defects.
8.5 When the goods are delivered to the address specified by the Buyer, it is considered that the goods have been delivered to the Buyer. If the planned delivery date of the goods is not met, the Buyer must immediately, but no later than the next day after the planned delivery date, inform the Seller. Otherwise, the Buyer loses the right to make claims to the Seller related to the delivery of goods.
8.6 If the Customer notices that the goods do not meet the requirements specified in the order, they must immediately, but no later than the next day after the delivery of the goods, contact the Seller by phone or email. The Seller undertakes to take all necessary actions to eliminate existing deficiencies if such deficiencies have arisen due to the fault of the Seller or third parties acting on behalf of the Seller.
9. Return of goods
9.1 The return of goods is carried out in accordance with the Order of the Minister of Economy of the Republic of Lithuania of August 17, 2001, No. 258 "On the approval of the rules for the sale of goods and the provision of services when contracts are concluded using communication means" and the Order of the Minister of Economy of June 29, 2001, No. 217 "On the approval of the rules for the return and exchange of goods".
9.2 Having purchased a product of unsatisfactory quality, the Buyer has the right to return such a product to the Seller within 7 (seven) working days from the day of its delivery to the Buyer. In this case, the product of unsatisfactory quality is replaced free of charge with a quality product or the Buyer is refunded the paid amount.
9.3 The exchange or return of goods is carried out upon receiving a request from the Buyer, which must specify what is being returned or exchanged, the order number, and the reason for the return or exchange.
9.4 In cases where goods are exchanged and a price difference arises during such exchange, the Buyer must pay such price difference. The price difference is paid by bank transfer to the specified bank account. In cases where the Seller cannot replace the product because they do not have the necessary goods, the Seller refunds the paid amount to the Buyer, excluding the delivery cost.
9.5 In all cases, the Buyer must return the product in its original packaging. Along with the exchanged or returned product, the document confirming the purchase from Lipdukai.eu must be attached, and the "Product exchange/return form" must be filled out.
9.6 The Buyer is responsible for the assembly and packaging of the exchanged/returned goods. If the item is not assembled and/or properly packaged, the Seller does not accept the returned item.
9.7 The Buyer may exercise their right to return the product if the product has not been used, the consumer properties of the product have been preserved, it is undamaged and has not lost its commercial appearance. The product must be delivered in an undamaged original package. Changes in the appearance of the product or its packaging necessary to inspect the product cannot be considered essential changes in the appearance of the product.
9.8 The Buyer bears the transportation or shipment costs, except in cases where the product is returned due to unsatisfactory product quality or manufacturing error.
9.9 Upon receiving the exchanged/returned goods, the Seller undertakes to replace the product or refund the paid amount within 7 days if the product meets the requirements specified for the exchanged or returned product as indicated in point 9.7.
9.10 Poor-quality products are exchanged or returned following the Rules for the return and exchange of goods approved by the Order of the Minister of Economy of June 29, 2001, No. 217 "On the approval of the rules for the return and exchange of goods," except in cases where the contract cannot be terminated according to the laws of the Republic of Lithuania (see information on the website of the VšĮ "Vartotojų centras" - "Features of returning and exchanging non-food products" point 18.) According to this point, products that were of poor quality but have options in colors, sizes, or designs are classified as non-returnable products.
10. Final provisions
10.1 All disputes arising from or related to the purchase and sale agreement between the Buyer and the Seller are resolved through negotiations. In case of failure to reach an agreement, disputes are resolved in the courts of the Republic of Lithuania, according to the Seller's registered place of residence.
